The Ministry of Finance proposes that Ho Chi Minh City review the regulations on fee collection for seaport infrastructure

On May 11, the Ministry of Finance issued Official dispatch No. 3978/BTC-CST to the People's Committee of Ho Chi Minh City on the review of fees for using seaport infrastructure.

Previously, on March 31, the Ministry of Finance received Officia dispatch No. 3206/UBND-KTNS from Dong Nai Provincial People's Committee and Officia dispatch No. 627/HQBD-GSQI dated March 29 from Binh Duong Customs Department regarding related to the Scheme on fee collection for the use of infrastructure, public utility services in the seaport border gate area in Ho Chi Minh City. At the same time, the Ministry of Finance also received Officia dispatch No. 05/BanIV dated April 4 from the Research and Development Board of the Private Economy to the Prime Minister to report on a number of shortcomings and negative impacts from the tax collection. fees for using seaport infrastructure in HCM city to business activities.

Regarding this issue, the Ministry of Finance issued Officia dispatch No. 2681/BTC-CST on March 17, Dispatch No. 6665/BTC-CST on June 21 and Official Dispatch No. 2748/BTC-CST on June 25 /3 sent to Ho Chi Minh City People's Committee.

The content of the official dispatches clearly states that the introduction of regulations on the fee difference between imported and exported goods opened declarations in Ho Chi Minh City. Ho Chi Minh City and opening declarations in other localities has caused inequality and discrimination.

According to Article 8 of the Law on Fees and Charges, the fee level is determined to basically cover costs, taking into account the State's socio-economic development policy in each period, ensuring fairness, publicity, transparency and equality in the rights and obligations of citizens.

Therefore, the Ministry of Finance proposes that the People's Committee of Ho Chi Minh City consider responding to the recommendations of businesses and report to the Prime Minister on the reasonableness of Resolution No. 10/2020/NQ-HDND, especially regulations. relating to the differential fee; reviewing the content of the Vietnam - Cambodia Waterway Transport Agreement to adjust the toll collection resolution to ensure fairness, publicity, transparency, and compliance with regulations.

In the official dispatch No. 3978/BTC-CST the Ministry of Finance sent to Ho Chi Minh City recently, the Ministry continued to request the People's Committee of Ho Chi Minh City to urgently report to the City People's Council to amend Resolution No. 10/2020/ NQ-HDND to create conditions for businesses and the economy to recover and develop after Covid; ensure fairness, publicity and transparency, in accordance with the provisions of the Law on Fees and Charges.
